GTC – General terms and conditions
Stadtliebe Hamburg
1. Registration
- With his registration the customer offers the conclusion of a contract based on the tour description and these terms and conditions. The registration can be made verbally, in writing or by e-mail
- The contract comes into effect after confirmation by Stadtliebe Hamburg. It does not require a fixed form and can be made verbally, in writing or by e-mail.
- In the case of public guided tours, the conclusion of the contract comes about through participation.
2. Performance, prices and method of payment
- The scope of the service results from the tour description and includes the guiding and commentary of the tour Further services can be explicitly mentioned
- The services are provided regardless of the weather. In case of unfavourable weather, a change of the means of transport can be made in mutual agreement (e.g. from bicycle to train / ship / on foot)
- Unless otherwise agreed, the prices stated in the respective tour descriptions apply. They contain the legal value added tax
- Not included in the price are all other services such as entrance fees, tickets or catering costs
- In principle, the customer receives a confirmation of order and an invoice after the service has been rendered
- In agreed cases and for public tours, payment can be made in cash before the beginning of the service
- In the case of rebooking or changes of date, Stadtliebe Hamburg reserves the right to charge an administration fee.
3. Cancellation / non-utilisation by the customer
- The guest has the right to withdraw from the contract at any time after it has been concluded. For the cancellation deadlines, the proven receipt of the notification by Stadtliebe Hamburg applies
- If the customer withdraws from the contract or does not take the agreed appointment, Stadtliebe Hamburg will charge a corresponding expense allowance:
- up to 7 days before the appointment: free of charge
- up to 72 hours before the tour: 50 % of the tour price
- 72 hours later 100 % of the tour price
- If the customer is more than 30 minutes late for the agreed meeting point, there is basically no entitlement to performance. If the tour is nevertheless conducted, there is no claim to an extension of the service corresponding to the delay
- In the event of premature termination of the service at the customer’s request, the agreed price is due without deduction.
4. Cancellation by Stadtliebe Hamburg
- Stadtliebe Hamburg reserves the right to withdraw from the contract in whole or in part in the following cases:
- if the minimum number of participants is not reached
in case of force majeure - if the customer or participants of the group persistently disrupt the performance of the service despite a warning
- if the client or participant of the group disregards the safety instructions of the tour guide with gross negligence
- if the client or participants of the group are not up to the requirements of the program due to a misjudgement of their ability
- if the minimum number of participants is not reached
- In these cases mentioned under 4.1. the claim to the agreed tour price is basically maintained. As far as possible, saved expenses will be credited.
Liability
- Stadtliebe Hamburg is liable for the proper preparation, the correctness of the service description and the proper provision of the service
- Stadtliebe Hamburg is not liable for damages caused by grossly negligent or intentional behaviour (e.g. in road traffic)
- Stadtliebe Hamburg is not liable for the services of third parties (e.g. bus companies or catering businesses).
6. Data Protection
The customer agrees that the data provided by him/her will continue to be used by Stadtliebe Hamburg for customer service. This data will not be passed on to third parties, unless the transfer is necessary for the proper performance of the services.
7. Place of Jurisdiction
Place of jurisdiction is Hamburg.
8. Severability Clause
If individual provisions of these GTC should be invalid, this shall not affect the validity of the remaining provisions or of the contract as a whole.
